Jury gives 24-year prison term for meth

A Payne County jury
has recommended a 24~year
prison term for a Stillwater
ex-convict who was found
guilty at a three-day trial last
week of possessing meth—
amphetamine with intent to
distribute after having been
previously convicted of fel-
onies. .
Derreck Ryan Gray, 33,
who has an extensive crim—
inal record, could have been
given as much as a life prison
term, court records show.
Prosecutor Karen Dixon
said that the jury composed
of seven men and five women
deliberated for about two
hours Thursday before find-
ing Gray guilty of the felony
methamphetamine count
and a misdemeanor count
of obstructing a Stillwater
police officer.
Jurors then deliberated for
about an hour before fixing
Gray’s punishment at 24
years in prison on the drug
count and one year in jail
plus a $500 fine on the mis—

the prosecutor said.
District Judge Phillip
Corley ordered a pre—sen-
tencing investigation and
told Gray, who remains in the
Payne County Jail, to return
to court on Oct. 28 for formal
sentencing.
Gray had been arrested
at about 6:30 p.m. on July
1, 2015 during a traffic stop
on a Ford in which he was a
passenger, according to an
affidavit by Stillwater Police
Officer William Cluck.
“As Gray stood up, I
noticed a plastic bag drop
to the side of the passenger
seat,” Cluck wrote in his
affidavit.
When Gray started to
walk toward Stillwater Police
Officer Michael Casteel, “he
stopped and started reaching
for the Walmart bag,” the
affidavit said.
“I told Gray to leave the
bag and he grabbed the bag
and turned toward Casteel. I
took control of Gray’s right
arm and he started trying to
pull away andrun through me
and Casteel,” Cluck wrote in
his affidavit.
“Casteel and I maintained a
hold of Gray and were able to
force him to the ground. Gray
would not comply with any
commands and kept trying
to puSh himself up and get
away,” Cluck wrote in his
affidavit.

BrettMoore and Cluc “gave
Gray several commands to
give us his arms, but he con-
tinued to fight and actively
resist. I applied a Taser drive
stun to Gray’s back and he I
continued to fight.
“I applied another Taser
application and he contin-
ued to fight, but Moore and
Casteel were able to force his
arms behind him and place
him in handcuffs,” Cluck
wrote in his affidavit.
“As we tried to get Gray off
of the ground, he kept trying
to kick the Walmart bag
under his body...I picked up
the Walrnart bag and noticed
that it contained a large bag of
methamphetamine and sev—
eral different types of pills,”
Cluck wrote in his affidavit.
The day. after Gray. was
charged in that methamphet-
amine case on which the jury
found him guilty last week,
he posted $15,000 bail and
was released from the Payne
County Jail, court records
show. '
However, three months
later Gray was again arrested
by Cluck during an Oct. 1
traffic accident at McElroy
and Jardot Streets, according
to another affidavit.
In that case, Gray was jailed
on $200,000 bail on charges
of methamphetamine traf-
ficking, possessing $1,212
derived from drug sales,
possessing cocaine and using
a stolen vehicle license tag
decal, as well as driving
under suspension and oper-
ating a truck with an expired
tag.
Gray had been released
from prison in April 2014
after serving less than half of
a five-year sentence for pos—
sessing drugs andra firearm,
state Department of Correc-
tions records show.
In his application for a
court-appointed attorney in
his methamphetamine traf-
ficking case, Gray said that he
earned money from raising
show chickens and American
pit bull terriers, records show.
Gray has been ordered to
appear in court on Sept. 23
for a pre-trial hearing in that
case, records show. \
